1. About us and these terms
PappAI is a professional nutrition software platform operated by Electric Flock Ltd, a company incorporated in England and Wales (Company Number 16375990), with registered office at 27 Old Gloucester Street, London, United Kingdom WC1N 3AX ("Electric Flock", "we", "us").
These Terms of Service ("Terms") govern your access to and use of the PappAI platform, including the web application and any associated APIs (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a practice or organisation, you confirm you have authority to bind that entity.
The Service is intended for licensed nutrition professionals and healthcare practitioners. It is not intended for use by or directed at consumers or patients directly.
2. The Service
PappAI provides nutrition professionals with tools to:
- Create, manage, and share personalised diet plans for their patients;
- Record and review patient health data and progress;
- Use AI-assisted features to generate draft diet plans and nutritional observations;
- Monitor patient adherence via a companion patient mobile application;
- Manage their professional schedule and patient caseload.
AI-generated outputs are decision-support tools only. They are proposals for the professional to review, modify, and approve. They do not constitute dietary prescriptions, medical diagnoses, or clinical advice, and must not be used as such without professional review.
3. Professional responsibility
You are solely responsible for all clinical, dietary, and professional decisions made in connection with your use of the Service. Nothing in the Service replaces your professional judgment or reduces your legal and ethical obligations to your patients under applicable professional regulations.
You must not use the Service in a manner that violates any applicable law or professional code of conduct, including rules on patient consent, confidentiality, and data protection.
4. Accounts and access
- You must provide accurate and complete information when registering.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must not share your account with third parties or allow unauthorised access.
- You must notify us immediately at support@pappai.it if you become aware of any unauthorised use of your account.
5. Subscription, free trial, and payment
The Service is provided on a monthly subscription basis. Current plans and pricing are available at pappai.it/pricing. All prices are exclusive of VAT unless otherwise stated.
New accounts include a free trial whose duration is shown on the registration page and on the Pricing page at the time of sign-up. No payment details are required to start the trial. At the end of the trial, you must select a paid plan to continue using the Service.
Subscriptions renew automatically on a monthly basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Payments are processed by Stripe, Inc. and are non-refundable except as required by applicable law.
6. Data processing and patient data
You are the data controller for your patients' personal data. Electric Flock Ltd processes that data as your data processor under Art. 28 GDPR. The full DPA text is available at /dpa-template. Executing the DPA is electronic and mandatory and takes place via a guided signing flow with an OTP code over SMS at the end of onboarding (page /onboarding/dpa-signature). The system records in an immutable registry: SHA-256 hash of the signed document, OTP send and verification timestamps, phone number that received the SMS, device IP address and user-agent. Without a valid DPA signature for the current version, the system technically blocks access to features that process patient data (Art. 28 GDPR — no processing of patient data in the absence of a binding written agreement).
You are responsible for ensuring you have a valid legal basis to process your patients' data, for providing them with appropriate privacy information, and for obtaining any required consents before entering their data into the platform.
7. Acceptable use
You must not:
- Use the Service for any unlawful purpose or in violation of applicable law;
- Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure;
- Introduce malware, viruses, or any harmful code;
- Reverse engineer, decompile, or create derivative works of the Service;
- Use the Service to process data of individuals who have not consented to such processing where required;
- Misrepresent your professional qualifications when using the Service.
8. Intellectual property
The Service, including its software, design, and content, is owned by Electric Flock Ltd or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service. You may use the Service solely in accordance with these Terms.
You retain ownership of all data you upload to the platform. You grant Electric Flock Ltd a limited licence to process that data solely to provide the Service to you.
9. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. Planned maintenance will be notified in advance where possible. We are not liable for losses caused by downtime beyond our reasonable control.
10. Limitation of liability
To the fullest extent permitted by law, Electric Flock Ltd's aggregate liability to you in connection with these Terms shall not exceed the fees paid by you in the 12 months preceding the event giving rise to the claim.
Electric Flock Ltd is not liable for: (a) AI outputs used without professional review; (b) clinical decisions made using the Service; (c) any indirect, consequential, or punitive losses; (d) loss of data caused by your own acts or omissions.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
11. Termination
You may terminate your account at any time via your account settings or by contacting support@pappai.it.
We may suspend or terminate your account if you materially breach these Terms, engage in fraudulent or abusive behaviour, or if required by law. We will give reasonable notice where practicable.
On termination, we will retain your data for the periods set out in our Privacy Policy and then delete it in accordance with our data retention schedule.
12. Changes to these Terms
We may update these Terms from time to time. We will give you at least 14 days' notice of material changes by email or via an in-app notification. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.
13. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. For B2B relationships with professionals acting in a business capacity, any dispute shall be subject to the jurisdiction of the courts of England and Wales.
